The Legal Status Of Flying With CBD

This question is in the murky grey area. CBD still falls under federally illegal even though it’s legal in all 50 states.

What TSA Has To Say About CBD

Possession of marijuana and cannabis infused products, such as Cannabidiol (CBD) oil, is illegal under federal law. TSA officers are required to report any suspected violations of law, including possession of marijuana and cannabis infused products. TSA’s screening procedures are focused on security and are designed to detect potential threats to aviation and passengers. Accordingly, TSA security officers do not search for marijuana or other illegal drugs, but in the event a substance that appears to be marijuana or a cannabis infused product is observed during security screening, TSA will refer the matter to a law enforcement officer.

When Flying With CBD Use Common Sense

When flying from a recreational legal state to another recreational state it’s safe to bring CBD & Marijuana with you. TSA is not checking for drugs. They are checking for security issues like knives, guns, explosives.

But what about the Farm Bill? Well the farm bill basically only made it federally legal for commercialized hemp cultivation which means farmers can grow CBD in the same way they grow Corn. No harsh restrictions, although state’s can put their own laws in place.

If you do decide to fly with CBD make sure to bring a printed lab test showing it’s less then .03% THC content. Make sure to put your CBD in your Carry On and not to exceed the maximum amount of liquid. Don’t bring a large amount. If traveling to a hotel you should arrange your hotel to receive a package for you and just ship it there.

Disclamier This is not legal advice
